Music Terms

● License Grant

By purchasing or downloading a music track by AvatarKage, you are granted a non-exclusive license to use said music in your projects if these agreement terms are followed. Do note that not all of AvatarKage's music is available for project use. If a track is available for project use under these terms then it will be listed in the official video, page, or store product description associated with said track. 

● Permitted Uses

You may use the music in your personal, non-commercial projects, including but not limited to internet videos, podcasts, films, games, and websites. You may also edit, remix, or otherwise modify the music as necessary for your projects. Non-commercial projects mean public or private projects freely accessible to a group or the general public without the restriction of a paywall or the intent of gaining income from the project. Brief commercial usage is permitted under the strict conditions of third-party monetization such as Google Adsense or the use of a support platform to help fund (including providing non-music in-game rewards), but not access, your projects such as Ko-Fi or Patreon. 

● Restrictions

● You may not use the music for illegal, defamatory, or obscene purposes.

● You may not resell or redistribute the music on its own, including solely posting largely non-modified (such as pitch or distortion edits) visualizers, lyrics videos, or compilation videos featuring less than 3 unique artists.

● You may not use the music on any project involving the use of unethical AI imagery.

● You may not claim ownership or authorship of the music, including the use of “official” in your video title when referring to the music or your remix of it. When posting a remix of the music, you must include “remix” in the title and not make it seem as if it is the original.

● You may not use the music in any context that may harm or damage the artist's reputation or brand including projects that revolve around real-world politics, religion, crypto, or other massively controversial topics.

● Attribution

You agree to credit the artist by including the artist's name and the title of the music in the project description or credits. Leaving a link to the music track isn't required but is appreciated. When providing attribution, you may not credit the artist in a manner that assumes usage approval or association with the artist.

● Indemnification

You agree to indemnify, defend, and hold the artist harmless from any claims, damages, expenses, and liabilities arising out of or in connection with your use of the music in your projects.

● Termination

You may terminate this agreement at any given time for any reason. Upon termination, you shall immediately cease using the music in your projects and remove all copies of the music from your possession.

By downloading or purchasing a music track for project use, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms and conditions, you may not use the music in your projects. Failure to follow these conditions may result in takedowns, content strikes, and in extreme cases, legal action against you.
