Commission Terms

● License Grant

By purchasing a commission by AvatarKage, you are granted a non-exclusive, non-transferable, and royalty-free license license to use said commission in your projects if these agreement terms are followed.

● Permitted Uses

You may use the commission in your personal, non-commercial (commercial license available) projects, including but not limited to internet videos, podcasts, films, games, and websites. You may also edit, remix, or otherwise modify the commission as necessary for your projects. Non-commercial projects mean public or private projects freely accessible to a group or the general public without the restriction of a paywall or the intent of gaining income from the project. Brief commercial usage is permitted under the strict conditions of third-party monetization such as Google Adsense or the use of a support platform to help fund (including providing non-commission in-game rewards), but not access, your projects such as Ko-Fi or Patreon. 

● Restrictions

● You may not use the commission for illegal, defamatory, or obscene purposes.

● You may not use the commission on any project involving the use of unethical AI imagery or for the sake of training AI.

● You may claim ownership but not authorship of the commission. Remixing the commission doesn't make it you its sole author but instead an author of the commission.

● You may not use the commission in any context that may harm or damage the artist's reputation or brand including projects that revolve around or involve real-world politics, religion, blockchain, or other massively controversial topics.

● Attribution

Credit for the commission isn't required for most projects but appreciated. For larger publishable projects such as music, video games, or films, you agree to credit the artist by including the artist's name in the project description or credits. When providing attribution, you may not credit the artist in a manner that assumes usage approval or association with the artist.

● Indemnification

You agree to indemnify, defend, and hold the artist harmless from any claims, damages, expenses, and liabilities arising out of or in connection with your use of the commission in your projects.

● Order Processing, Restrictions, & Refund Policy

All orders will be completed in the order they are received unless you select the Speed Delivery addon, which prioritizes orders during periods of high demand. A 100% refund (excluding third-party fees) will be issued if the artist is unable to fulfill the requested commission. Cancellations or requests for changes that cannot be accommodated will not be refunded in full, due to the significant time and effort already involved in the process. A 50% refund may be issued in cases of dissatisfaction, provided the circumstances are reasonable. By purchasing a commission you agree to be listed on the artist's public records for identification and permissions approval purposes.

In order to maintain a specific profile, avoid controversial topics, and prevent legal issues, the following commissions will be automatically rejected. Do not purchase if your commission request contains:

● NSFW (Not Safe for Work) or suggestive content

● Religious content or symbols

● Political content or symbols

● LGBTQ+ content or symbols

● Real-world public figures (unless you have a personal or work connection with them)

● Real-world brands or organizations symbols (unless you have a personal or work connection with them)

● Copyrighted content (unless you are the author or have permissions to use the content)

● Commercial License

To use the commission commercially, you must purchase a commercial license. The commercial license can be acquired through the available addons or by sending $99.99 USD via PayPal or Ko-Fi at any given time. Upon purchase, you will an email receive a document granting commercial usage rights and the commission will be marked on artist's public records under commercial use for identification and permissions approval purposes. When paying, you need to include the name or order number of your commission.

Non-profit organizations may request a free non-profit license by emailing the artist at contact@avatarkage.com with the subject line "NON-PROFIT LICENSE - YOUR_ORGANIZATION_NAME."

● Termination

You may terminate this agreement at any given time for any reason. Upon termination, you shall immediately cease using the music in your projects and remove all copies of the music from your possession.

By downloading or purchasing a music track for project use, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree to these terms and conditions, you may not use the music in your projects. Failure to follow these conditions may result in takedowns, content strikes, and in extreme cases, legal action against you.

● Legal Note: The artist cannot grant commercial usage rights for official Minecraft assets owned by Microsoft Studios. For Minecraft-related commercial commissions, you must approach Microsoft’s legal team.
